Trademark Registration in India

Your brand name, logo and business identity help customers recognize your products and services. Trademark registration provides legal protection for distinctive brand identifiers and helps businesses establish ownership over their registered marks in relation to specified goods or services.

Whether you are starting a new business or already operating an established brand, registering your trademark can help protect your brand identity. GetMunshi assists businesses in understanding the trademark application process, selecting relevant trademark classes and preparing the required application information.

What is Trademark Registration?

A trademark is a distinctive sign that identifies and distinguishes the goods or services of one business from those of another. It may include a brand name, logo, symbol, slogan, shape, sound or other legally recognized mark.

In India, trademarks are registered under the Trade Marks Act, 1999. Applications are processed by the Trade Marks Registry under the Office of the Controller General of Patents, Designs and Trade Marks.

Once registered, a trademark gives its proprietor statutory rights in relation to the goods or services covered by the registration, subject to applicable legal provisions.

Types of Trademarks

Depending on the nature of your brand identity, different types of trademarks may be considered for registration.

1. Word Mark

Protects a distinctive brand name, word, letters or combination of words. It can help protect the name independently of a particular logo style.

2. Device Mark / Logo

Covers a distinctive logo, symbol, graphic design or stylized representation used to identify a business or its products.

3. Slogan Mark

A distinctive slogan or tagline used to identify and distinguish a brand may qualify for trademark protection.

4. Shape Mark

Protects a distinctive shape of goods or packaging, provided it satisfies the applicable legal requirements.

5. Sound Mark

A distinctive sound associated with a brand may be registered if it meets the relevant requirements and can be represented appropriately.

6. Colour Combination Mark

A distinctive combination of colours associated with goods or services may qualify for protection under applicable trademark provisions.

Who Can Apply for Trademark Registration?

Any individual or legal entity claiming to be the proprietor of a trademark that is used or proposed to be used can apply for registration, subject to the applicable requirements.

  • Individuals and Sole Proprietors
  • Private Limited Companies
  • One Person Companies (OPCs)
  • Limited Liability Partnerships (LLPs)
  • Partnership Firms
  • Startups and Small Businesses
  • Trusts and Societies
  • Other Eligible Business Entities

Trademark Classes in India

Trademarks are registered for specific goods and services under the Nice Classification system. There are 45 trademark classes in total. Selecting the correct class is important because trademark protection is linked to the goods or services mentioned in the application.

Class Range Category Examples
Class 1–5 Chemicals and related goods Chemicals, paints, cosmetics, medicines
Class 6–14 Industrial and consumer goods Metal goods, machinery, electronics, jewellery
Class 15–25 Consumer products Musical instruments, paper goods, clothing
Class 26–34 Other goods Accessories, furniture, food products, beverages
Class 35–39 Business and commercial services Advertising, business management, transport
Class 40–45 Professional and other services Manufacturing services, education, technology, legal services

Classes 1–34 generally cover goods, while Classes 35–45 cover services. If a business operates in multiple categories, applications may be required in more than one class.

Documents Required for Trademark Registration

The documents and information required depend on the applicant category, nature of the mark and whether the trademark is already in use.

  • PAN Card of the Applicant or Business, where applicable
  • Identity and Address Proof
  • Business Registration Proof, where applicable

Trademark Registration Process

Trademark registration in India generally involves availability checks, application filing, examination, publication and registration. The application is filed online using Form TM-A.

Step 1: Trademark Search

Search the existing trademark database to identify identical or similar marks. This helps assess potential conflicts before filing an application.

Step 2: Select the Appropriate Class

Identify the relevant goods or services and select the appropriate trademark class or classes under the Nice Classification system.

Step 3: Prepare the Application

Prepare the applicant details, trademark representation, goods or services description and supporting documents.

Step 4: File Form TM-A

Submit the trademark application to the Trade Marks Registry and pay the applicable government fee. An application number is generated after filing.

Step 5: Examination by the Registry

The Registry examines the application for legal requirements and possible conflicts with existing trademarks. An examination report may raise objections that require a response.

Step 6: Reply to Objection, If Any

If objections are raised, the applicant may need to submit a suitable reply and supporting documents. A hearing may also be scheduled where required.

Step 7: Publication in Trademark Journal

Once accepted, the trademark application is published in the Trade Marks Journal. Third parties can oppose the application within the prescribed four-month opposition period.

Step 8: Registration Certificate

If no opposition is filed within the prescribed period, or any opposition is decided in favour of the applicant, the trademark may proceed to registration and a certificate can be issued.

Benefits of Trademark Registration

Registering a trademark can provide several legal and commercial benefits to businesses.

  • Brand Protection: Provides statutory rights over the registered mark for the specified goods or services.
  • Exclusive Rights: Gives the registered proprietor exclusive rights to use the mark in relation to the registered goods or services, subject to applicable law.
